No individual to be compelled to provide proof of Aadhaar number unless provided by law

Cabinet approves The Aadhaar and Other Laws (Amendment) Bill, 2019

In a major move aimed at making Aadhaar making people friendly, the Union Cabinet, chaired by the Prime Minister Narendra Modi has approved “The Aadhaar and Other Laws (Amendment) Bill, 2019” to replace the Aadhaar and Other Laws (Amendment) Ordinance, 2019. The amendments proposed are the same as those contained in the Ordinance promulgated by President on 2nd March, 2019. The Bill will be introduced in ensuing session of Parliament.

  • No individual to be compelled to provide proof of Aadhaar number unless provided by law.
  • Aadhaar number on voluntary basis to be accepted as KYC document.

The decision is expected to go a long way in meeting the people friendly and citizen centric nature of Aadhaar.

Impact:

The decision would enable UIDAI to have a more robust mechanism to serve the public interest and restrain the misuse of Aadhar.

Subsequent to this amendment, no individual shall be compelled to provide proof of possession of Aadhaar number or undergo authentication for the purpose of establishing his identity unless it is so provided by a law made by Parliament.

For the convenience of general public in opening of bank accounts, the proposed amendments would allow the use of Aadhaar number for authentication on voluntary basis as acceptable KYC document under the Telegraph Act, 1885 and the Prevention of Money Laundering Act, 2002.

Details:

The salient features of the amendments are as follows—

Provides for voluntary use of Aadhaar number in physical or electronic form by authentication or offline verification with the consent of Aadhaar number holder;

Provides for use of twelve-digit Aadhaar number and its alternative virtual identity to conceal the actual Aadhaar number of an individual;

Gives an option to children who are Aadhaar number holders to cancel their Aadhaar number on attaining the age of eighteen years;

Permits the entities to perform authentication only when they are compliant with the standards of privacy and security specified by the Authority; and the authentication is permitted under any law made by Parliament or is prescribed to be in the interest of State by the Central Government;

Allows the use of Aadhaar number for authentication on voluntary basis as acceptable KYC document under the Telegraph Act, 1885 and the Prevention of Money-laundering Act, 2002;

Proposes deletion of section 57 of the Aadhaar Act relating to use of Aadhaar by private entities;

Prevents denial of services for refusing to, or being unable to, undergo authentication;

Provides for establishment of Unique Identification Authority of India Fund;

Provides for civil penalties, its adjudication, appeal thereof in regard to violations of Aadhaar Act and provisions by entities in the Aadhaar ecosystem.

YS Jagan’s first speech in Andhra Pradesh Assembly

  • In his first speech in the new AP Legislative Assembly AP CM YS Jagan recalled the engineered defection of 23 of his party MLAs and three MPs by the TDP and in the current elections the TDP winning exactly the same number of MLA and MP seats they had weaned away from YSRCP.
  • The AP CM also said that when some people suggested that the YSRCP could wean away four or five MLAs from the TDP in order to deny TDP Chief Chandrababu Naidu the position of the Leader of Opposition. He said he will not do such a thing. In the event of anyone defecting to their side they will be asked to resign their seat before joining or will be disqualified by the Speaker.
  • YS Jagan also said four of their MLAs’ from their ranks were made to shift to the treasury benches and were even made Ministers. His representation to disqualify them went unheeded.
  • He also spoke about empowering the backward communities and said as per the party’s assurance the Backward Communities will be transformed to Backbone Communities for the society.

The original statue was sculptured between the 4th and 7th centuries AD.

This replica of the Samadhi Buddha Statue has been hand carved using white teak.

This masterpiece has taken almost two years to complete.

$287 Million Loan Agreement signed for Tamil Nadu Health System Reform Program

The Government of India, Government of Tamil Nadu (GoTN) and the World Bank  signed here today in New Delhi a $287 Million Loan Agreement for the Tamil Nadu Health System Reform Program. The Program aims to improve the quality of health care, reduce the burden of Non-communicable Diseases (NCDs), and fill equity gaps in reproductive and child health services in the State of Tamil Nadu.

The Tamil Nadu Health System Reform Program will support the State Government to:

  • develop clinical protocols and guidelines;
  • achieve national accreditation for primary, secondary, and tertiary-level health facilities in the public sector;
  • strengthen physicians, nurses and paramedics through continuous medical education;
  • strengthen the feedback loop between citizens and the state by making quality and other data accessible to the public.

“Tamil Nadu can serve as a model for how to take health system performance to the next level by investing in the public sector and offer lessons to other states. We are happy that the World Bank is helping the state in this journey,” said Mr. Sameer Kumar Khare, Additional Secretary, Department of Economic Affairs, Ministry of Finance.

“The Program supports interventions to strengthen institutional and state capacity to achieve results. Good practices and innovations from Tamil Nadu are being scaled-up while others from around the world are being introduced through the program to improve management of the State’s Public Health Sector, increase transparency, and strengthen accountability,” said Mr. Hisham Abdo, Acting Country Director, World Bank.

The Program will promote population-based screening, treatment and follow-up for NCDs, and improve monitoring and evaluation. Patients will be equipped with knowledge and skills to self-manage their conditions. Lab services and health provider capacity will also be strengthened to address mental health. To tackle road injuries, the program will improve in-hospital care, strengthen protocols, strengthen the 24×7 trauma care services and establish a trauma registry.

Another key aim of this Program is to reduce the equity gaps in reproductive and child health.  Special focus will be given to nine priority districts, which constitute the bottom quintile of the RCH indicators in the State and have a relatively large proportion of tribal populations.

“This Program focuses on results instead of inputs through a Program-for-Results (PforR) lending instrument. This will provide a much greater focus on outputs and outcomes through better alignment of expenditures and incentives with results,” said Mr. Rifat Hasan, Senior Health Specialist, World Bank India, and the Task Team Leader for the Program. The use of the PforR instrument is a first for the health sector and will offer lessons for other States.
